Are you the owner of a small or home based business? Do you report your income on Schedule C? If so, get ready for an audit. The IRS in at least two states is staffing up to perform audits on virtually all non-farm Schedule C filers. Other states are sure to follow. Here’s why.

There is a “tax gap” of around $290 Billion a year. The IRS believes a significant portion (but no where near the majority) of that is due to under reporting of income by small businesses who report using Schedule C. With the budget deficits growing and the economy shrinking the IRS is under pressure to close the “tax gap”. So why target small business? It’s a lot easier than going after the big corporations.

IRS Commissioner Mark Everson testified to the Investigative subcommittee of the U.S. Senate Homeland Security and Governmental Affairs Committee, “We have real difficulties finding out what’s going on (with large corporations),” he said. “Our challenges are acute and ever-growing. Offshore abuses are a real problem.” In other words, small businesses are simply easier to go after since the large corporations can use such evasive tactics as offshore tax havens and other shelters not available to the small business owner.

What can you do? First of all, make sure you keep very good records of all income and deductions. You must be prepared for an audit because there is a bull’s eye painted on your chest if you file a Schedule C.

Alternatively, you can change the structure of your business from a sole proprietorship to a partnership or corporation. The likelihood of being audited drops precipitously for these other structures. Formation of a partnership is easy and inexpensive. You can do it yourself or ask your accountant or attorney to do it for you. Setting up a corporation is a bit more complex and will cost more to establish but may be the best choice depending on your personal situation. Seek professional advice from your accountant and attorney to determine what structure is most appropriate to your situation.

The good news is there are people working to help you with this challenge. The Coalition for Fairness in Tax Compliance was begun by the NFIB. The Small Business Legislative Council and the U.S. Chamber of Commerce joined with them to defend against harmful tax proposals. They are at least sounding the alarm on our behalf. They are also suggesting to the IRS that just because large corporation’s tax liabilities are hard to determine doesn’t mean the IRS shouldn’t pursue these companies.

It all started with a misread itinerary. When we got to the Orlando airport yesterday I inserted my CC in the machine to get boarding passes and got the message, “Your flight has already departed. Please see a ticket agent.” After trying three more times to see if it would change I went to see a ticketing agent. She gave us “standby” tickets for a later flight with a change of planes in Atlanta.

The Atlanta airport was then shut down for several hours due to bad weather and a failed ground radar system. As a result our flight to Atlanta was delayed from 1:30 p.m. to 3:30 p.m. and our flight from Atlanta to Kansas City was delayed from 8:45 p.m. to 10:33 p.m. this was already seeming like a long day. When we finally got to KC about 1:00 a.m today our son’s car died.

After two policemen stopped to help us and calling our auto service and a taxi we got to a motel and had the car towed to an auto shop. We all got to bed about 3:30 a.m. Oh, did I mention we live in Omaha which is a 21/2 hour drive from KC?

Today while waiting for the call from the mechanic to find out the car needed a new catalytic converter the weather channel informed us that there was freezing rain to be followed by snow along our projected route home today and that travel was not recommended. Consequently, I am writing this at 5:00 p.m. in our motel room. By the way, it is now snowing as predicted. Tomorrow is supposed to be a much better travel day. I certainly hope so.

Does your family have Christmas traditions? Ours does. It is an interesting characteristic of our family traditions is that we modify them from time to time. The reasons for modification can be as varied as children growing up and moving away to grand children being born to moving to new homes.

When our children were small we instituted several traditions. One was to attend a Christmas Eve candlelight service at church. Another was allowing each of the children to open one present on Christmas Eve.

On Christmas Day, before opening our presents, we would have aebliskivers for breakfast. We aren’t Danish but we fell in love with these little globes of batter with the surprise filling inside and included them in our Christmas morning celebration.

When we lived in Germany we visited the CristKindlemarkt every year and came to enjoy lebkuchen and gluhwein which were always sold from booths at these festive markets.

When we lived in England we learned about the holiday called “Boxing Day.” It is the day after Christmas and is a designated holiday in England and Canada and several other countries. We established a tradition of hosting a “Boxing Day Party” every year on December 26th. We always served the German gluhwein at the Boxing Day party. So we created a truly international tradition.

Now that our children are grown and have families of their own these traditions have changed. Church is still a part of Christmas Eve but the aebliskivers are now shared later in the day when the children and grand children come over to the house after opening their presents at their homes. The Boxing Day Party is now hosted by our children or their friends and we just attend. The gluhwein is still featured at this party. Sometimes I am asked to make it but more often now someone else is in charge of it.

We just finished a 4 day visit to Disney World. there were 8 adults and 7 kids. In order to keep track of everyone my wife bought royal blue baseball caps for everyone. We all wore them every day and we were always able to find the members of our party whenever we were separated. The bright blue color was very easy to see at a distance and was very distinctive. It worked really well.

Another advantage of all of us having the hats presented itself when cast members started referring to us as the “blue hat bunch.” This recognition helped us several times to get the entire group on rides in adjacent cars or boats instead of being separated.
